Subject: Texas Law on the Use of E-Cigarettes, Tobacco, and Vape Products on School Premises

Dear Parents and Guardians,

This is a reminder of important state laws regarding tobacco, e-cigarettes, and vape products on public
school property. In Texas, it is illegal for adults to use e-cigarettes, tobacco products, or vape products
on the premises of any public primary or secondary school. This prohibition applies to both indoor and
outdoor areas, as well as to school-related activities—even if those activities are held off-campus.

Violations of this law are considered a criminal offense.
What the Law Requires Under Texas Education Code §38.006:
• Vaping and Smoking: The use of an e-cigarette or smoking a tobacco product in any school
facility is a criminal offense for all individuals.
• School Grounds: The prohibition applies to all areas of the campus, including buildings,
vehicles, and before/after-school programs.
• School-Related Activities: The ban extends to all district events and activities, regardless of
location.

Penalties for Adults According to Texas Penal Code §48.01:
• Adults who use e-cigarettes, vape products, or tobacco on school property or at school-related
events may be removed from the premises.
• Violations may result in criminal charges and fines.
